1. Acceptance of Terms

By accessing or using the BLACKNODE platform (blacknode.tech), you agree to be bound by these Terms of Service. If you do not agree, do not use our services. We may update these terms at any time — continued use constitutes acceptance.

2. Description of Service

BLACKNODE is an AI-powered business platform that provides:

• AI content generation (videos, scripts, images)
• Virtual AI influencer creation and management
• Automated email sequences
• Landing page hosting and management
• LinkedIn outreach automation
• Social media publishing tools
• Social media publishing to TikTok, Facebook, and Instagram
• Auto video editing with AI

The platform operates on a credit-based system and is available as a web application.

3. Account Registration

• You must provide accurate, complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the platform
• One person per account (no shared accounts unless authorized)
• You must notify us immediately of any unauthorized access

4. Credit System & Payments

• Credits are the platform's currency for AI-powered features
• Credits are purchased in advance and are non-refundable
• Credit costs vary by feature (e.g., video generation, script writing, photo generation)
• Some features are free and do not require credits (email sequences, landing pages)
• Prices may change with 30 days notice
• All payments are processed securely through Stripe
• Unused credits do not expire

5. Acceptable Use

You agree NOT to:

• Use the platform for illegal activities
• Generate content that is harmful, defamatory, or violates third-party rights
• Attempt to reverse-engineer, hack, or compromise the platform
• Use automated tools to access the platform (beyond provided APIs)
• Create content depicting minors in any inappropriate context
• Resell platform access without authorization
• Violate LinkedIn's, TikTok's, or Meta's terms of service or community guidelines when using automation or publishing features
• Send spam or unsolicited commercial messages through the platform
• Upload malware or malicious content
• Exceed fair use limits or abuse the credit system

6. AI-Generated Content

• Ownership: You retain ownership of content you generate using the platform
• Responsibility: You are solely responsible for reviewing, editing, and publishing AI-generated content
• Accuracy: AI-generated content may contain errors, inaccuracies, or inappropriate material — review before use
• No Guarantee: We do not guarantee that generated content will be suitable for any particular purpose
• Third-Party Processing: Content generation involves third-party AI providers (Google Gemini, xskill.ai) — their terms may also apply
• License to Us: You grant us a limited license to process your inputs solely for the purpose of generating your requested content

7. Content Moderation

• We reserve the right to review and remove content that violates these terms
• We may suspend or terminate accounts that repeatedly violate our policies
• We comply with applicable laws regarding illegal content reporting
• You may report inappropriate content to info@blacknode.tech

8. LinkedIn Automation Disclaimer

• LinkedIn automation features are provided as tools — you are responsible for compliance with LinkedIn's terms
• We implement rate limiting and safety measures, but cannot guarantee LinkedIn will not restrict your account
• BLACKNODE is not affiliated with or endorsed by LinkedIn
• We are not liable for any LinkedIn account restrictions resulting from the use of our tools
• You should review LinkedIn's User Agreement before enabling automation features

8b. Social Media Platform Disclaimers

• BLACKNODE is not affiliated with, endorsed by, or sponsored by TikTok, Meta (Facebook/Instagram), or any other social media platform
• Social media publishing features require you to connect your own account via OAuth — we act on your behalf with your explicit authorization
• You are responsible for compliance with each platform's terms of service and community guidelines
• We are not liable for any account restrictions imposed by TikTok, Meta, or other platforms resulting from the use of our tools
• Content published via our platform is subject to each platform's API rate limits and availability — we are not liable for failed or delayed posts due to platform restrictions
• You may revoke BLACKNODE's access at any time from your TikTok or Meta account security settings
• By using our TikTok integration, you also agree to TikTok's Terms of Service and TikTok Community Guidelines
• By using our Facebook/Instagram integration, you also agree to Meta's Terms of Service

9. Landing Pages & Email Compliance

You are responsible for ensuring your landing pages and email campaigns comply with:

• CAN-SPAM Act (USA)
• GDPR (EU)
• CASL (Canada)
• Any other applicable anti-spam or privacy legislation

• All email sequences must include an unsubscribe mechanism (provided by the platform)
• You must not use landing pages or email tools for phishing, fraud, or deceptive practices
• We may disable landing pages or email sequences that violate these requirements

10. Intellectual Property

• The BLACKNODE platform, including its design, code, and AI systems, is our intellectual property
• "BLACKNODE" is our trademark — you may not use it without permission
• You retain ownership of your original content (product descriptions, uploaded media)
• Third-party content (fonts, icons, AI models) remains the property of their respective owners

You agree to indemnify and hold harmless BLACKNODE, its operators, and affiliates from any claims, damages, or expenses arising from:

• Your use of the platform
• Content you generate or publish
• Your violation of these terms
• Your violation of any third-party rights

13. Termination

• You may close your account at any time by contacting info@blacknode.tech
• We may suspend or terminate your account for violations of these terms
• Upon termination, your right to use the platform ceases immediately
• We may retain certain data as required by law or for legitimate business purposes
• Unused credits are non-refundable upon termination for cause

14. Governing Law

• These terms are governed by the laws of the Czech Republic
• For EU residents: you retain any mandatory consumer protections under your local law
• Disputes will be resolved through the courts of the Czech Republic
• EU consumers may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

15. Changes to Terms

• We may modify these terms at any time
• Material changes will be communicated via email or platform notification at least 30 days in advance
• Continued use after changes take effect constitutes acceptance
• If you disagree with changes, you may close your account before they take effect
